In a move that has stirred controversy on the global stage, former and current U.S. President Donald Trump has signed an executive order imposing sanctions on the International Criminal Court (ICC), accusing the court of conducting “illegitimate and baseless actions targeting America and its close ally Israel.
”The executive order, which was signed as Israeli Prime Minister Benjamin Netanyahu was visiting Washington, imposes financial and visa restrictions on individuals and their families who assist in ICC investigations involving American citizens or Israeli officials.
The timing of the executive order has raised eyebrows, especially following the ICC’s issuance of an arrest warrant for Netanyahu in November 2024, accusing him of war crimes in Gaza—an allegation that Israel has firmly denied.
The ICC also issued an arrest warrant for a Hamas commander, further compounding the tense political climate. Trump's actions, according to a White House memo, are a direct response to the ICC’s “shameful moral equivalency” between Hamas and Israel, especially with both arrest warrants being issued at the same time.
The U.S. claims that the court’s actions could expose Americans and Israelis to potential harassment, abuse, and even arrest.
A key point in Trump’s executive order is its criticism of the ICC for jeopardizing U.S. sovereignty and undermining America’s national security and foreign policy, especially concerning its critical relationship with Israel. These sanctions were later lifted by President Joe Biden’s administration.While the U.S. is not a member of the ICC and has consistently rejected any form of jurisdiction by the court over American officials or citizens, more than 120 countries are members, including several European nations. The ICC was established to serve as a court of last resort, intervening only when national authorities are unable or unwilling to prosecute war crimes, crimes against humanity, and genocide.
In response to the U.S. sanctions, Dutch Foreign Minister Caspar Veldkamp expressed regret over the decision, emphasizing that the work of the ICC is essential in the fight against impunity.
The Netherlands is home to the ICC's headquarters in The Hague, and its officials have been vocal about their opposition to the U.S. stance.Meanwhile, Trump’s executive order comes on the heels of his controversial comments about Gaza.
In a recent joint press conference with Netanyahu, Trump announced a plan for the U.S. to "take over" Gaza after the conclusion of the Israel-Hamas conflict. The plan, which includes resettling Gaza’s Palestinian population, has faced backlash from Arab leaders and the United Nations.
Critics have questioned the specifics of the plan, particularly regarding the fate of Gaza’s two million residents. Trump’s social media posts have since clarified that any displacement would be temporary.
